Bradford Cohen, the Florida-based lawyer of Grammy-nominated rapper Kodak Black, has criticized the Justice Department’s decision to allow Hunter Biden, President Joe Biden’s son, to plead guilty to federal tax and firearms charges with no expected prison time or felony convictions. Cohen took to social media on Tuesday, questioning the fairness of the American justice system.
In an Instagram post, Cohen wrote: “2 tiers of justice? Kodak was charged for the same crime. Got over 3 years. Mr. Biden will not serve a day. Feels right? Do FBI agents and federal authorities take cases personally?” The comment referenced Black’s 2019 conviction where he was sentenced to 46 months in prison for providing an incorrect Social Security number to purchase firearms – the same crime Hunter Biden was charged with.

The rapper, whose real name is Bill Kapri, had a prior criminal record which, according to Cohen, makes the disparity between his sentence and Hunter Biden’s expected outcome more apparent. Black was pardoned by former President Donald Trump on his last day in office in January 2021.
Speaking on Twitter, Cohen, a veteran of the criminal justice system, stated that he has never had a client avoid prison time after pleading guilty to illegal possession of a weapon and tax evasion charges. “After 26 years, I have yet to have a plea in a case with an illegal possession of a weapon and tax evasion, that did not come with some kind of prison sentence. Indigents charged the same way would be getting jail time,” Cohen asserted.
Cohen added that the system often imposes prison sentences for even lesser offenses, referring to cases of parents jailed for paying off coaches to secure their children’s college admission. “Even in the case of paying off coaches to get their kids into college came with a prison sentence. One even got 2 weeks, even though she was scoring no jail time. The system was so petty that they made her surrender to a federal prison for 2 weeks! But in this case nothing,” Cohen lamented.
The charges against Hunter Biden, which were announced by Delaware US Attorney David Weiss’ office on Tuesday, follow a five-year investigation into Biden’s failure to report millions of dollars in income from countries such as China and Ukraine. Cohen’s statements reflect a growing concern about perceived disparities in the American justice system, as they show the stark contrast in treatment between high-profile figures and ordinary citizens when charged with similar crimes.
