This development follows the collapse of a plea agreement in July, under which Biden was expected to plead guilty to two misdemeanor tax counts of willful failure to pay federal income tax, in order to avoid jail time for a felony gun charge.
The charges stem from a 2018 incident when Hunter Biden allegedly lied on a federal form while purchasing a firearm. Initial reports suggest that a gun owned by Biden was disposed of in a trash can outside a market in Delaware. The gun was reportedly thrown away by Hallie Biden, widow of President Biden’s late son Beau, who was in a relationship with Hunter at the time.
The case took a turn when U.S. District Judge Maryellen Noreika declined to accept the plea and pretrial diversion agreements with Hunter Biden during his first court appearance related to the charges. She described the Department of Justice’s deal as unconstitutional and nonstandard. Following this, Hunter Biden pleaded not guilty to two misdemeanor tax charges and one felony gun charge.
In the wake of these developments, Attorney General Merrick Garland appointed Weiss as special counsel to oversee the investigation into Hunter Biden. Weiss has been leading the Hunter Biden investigation for years, and his appointment comes amid allegations of politicization impacting prosecutorial decisions in the ongoing investigation.

It’s important to note that Hunter Biden was discharged from the Navy in 2014 after testing positive for cocaine. On the firearm transaction report, he had answered in the negative when asked if he was “an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance.”
This impending indictment is the latest chapter in the legal saga surrounding Hunter Biden, who has faced scrutiny over his business dealings and personal life. The outcome of the case could have significant implications for the Biden administration, which has faced criticism from Republicans over Hunter Biden’s actions.
